The NYC parking ticket fine and penalty settlement program ends today, January 31, 2012. Reports of the settlement program's demise are not premature...unfortunately.

In protest against this cruel and usual punishment , New York Parking Ticket LLC offers the driving community "FREE FRIDAY" on February 3, 2012.

Larry (that's me) will man the telephone from sunrise to sunset and answer any questions about your NYC parking tickets, help you come up with a winning defense, and suggest how to present the proper proof persuasively to a parking ticket judge.

The best part of  FREE FRIDAY is it's FREE. Who doesn't like, "FREE?"

Commentary

I want to help us make the transition from having the option of a paying a reduced fine instead of fighting your NYC parking tickets---to the Evil Empire threatening you with the ultimatum, "pay in full, or fight!"

It's not right.

It is my wish that the members of the driving community who pay 7,000,000 parking tickets, no questions asked, will re-think this un-thinking reflex action of reaching into their wallets and turning over their hard-earned dough to the Evil Empire.

When you're right-FIGHT.

Present the proper proof persuasively.

I've taken advantage of the settlement program several times and, like many others, will be sad to see it ride off into the sunset. In protest, I plan to plead not guilty to every parking ticket I receive in the future, regardless of whether or not it was issued justly. Perhaps, if they are inundated with countless not guilty pleas (by mail or otherwise), the city will rethink their approach? Who's with me?

You voiced my sentiments, exactly. 
 
Can you image what would happen in the criminal or civil court system if there were no plea bargains, or civil settlements? It would be chaos... 
 
How about 7,000,000 not guilty pleas in the wacky world of NYC parking tickets. Mayor B thinks the City was paralyzed during the blizzard?

Since the advent of the settlement program, what I understood to be the case was that the Administrative Law Judges (ALJs) were not allowed to reduce the fines if found guilty after a trial.  
 
I have talked to motorists, though, who have had trials and gotten reductions (sometimes bigger ones than allowed by the settlement). What I suspect will be the case is that when the ALJs know that a motorist was not given (and blown off) a settlement offer they will be more likely to reduce if they feel you're "guilty...but not so much" (like the old Guilty with Explanation plea option that the Settlement Program replaced).

Not only will i be pleading guilty to every ticket I receive, if a verdict of guilty is issue,I will appeal the ticket, citing chapter and verse of parking law, indicating facts regarding the inabilities of these parking attendent. I will do it each and every time, and after receiving an answer from the appeals court, I will than file a complaint against both adjuncts and bombard emails to the dot commish

Larry, good morning. I previously read your blog on ramps and parking tickets and wished to give you an update with my experience/victory. I was concerned but the results were victorious. I was parked at E138th & Park Ave, Bronx, NY. There is an alleged pedestrian ramp numerous feet from the crosswalk right in the street. Apparently I was no different from any other victim of the park and ride (train station nearby). My car was tolled ($185), and then i was ticketed for blocking a pedestrian ramp ($165). I took pictures, but when i went to the Dept of Finance i didn't have too much time and opt to request a ticket reduction which was denied. They said i had to see the Judge. I went to see the Judge, showed him the pictures, the ruling, NOT GULTY. The city had to refund me the toll fee and i didn't have to pay the ticket. Now i have submitted a claim with the City's Comptroller's office because my vehicle is a 4x4 and they dragged causing severe damage to the rear differental among other things. I update you on my thus far partial victory because i know there are other victims that park there and there will continue to be other victims. should you like a copy of my Court Order as it would be a president for other victims to fight for their rights please advise I will gladly provide. Boy, I hope you're right (and I'm wrong).  
 
Parking ticket judges were prohibited by law from reducing a parking ticket fine after a member of the driving public refused a settlement offer, requested a trial, and was found guilty.  
 
Now, the Evil Empire with the advice and consent of Mayor B ended the settlement program. But, it was replaced by a much smaller version called the Reduction program. 
 
The new, smaller scale, program authorizes a reduced fine for people who appear for in-person hearings at one of the business offices in each of the 5 boroughs (less the recently closed office). These passionate, hearty, soles will be offered a fine reduction, PRIOR to their hearing.  
 
If accepted, a guilty plea and fine reduction will end the matter. 
 
That's the real deal. If a judge followed his sense of justice and fair play in the past, I hope this act of defiance continues.

Bravo! 
Not only for your passion fighting when you were right. But, for seeing the "big picture."  
 
If many of the members of the driving public continue to do their best impression of lemmings following the Darth Vaders of the world, because they are unwilling to take some of their valuable time to fight an unjust parking ticket, there will be no justice. 
 
It may be difficult to effect change with the power of one, but how about the power of the people who blindly pay 7,000,000 parking tickets without question. 
 
What if these people decide they are mad as hell, and don't put up with this bad behavior any longer? 
 
That's when you'll see real change. 
 
Again, kudos for your wonderful offer, and the super outcome.

Thank u Larry for being the warrior u are. After receiving a ramp ticket, I searched the web and found the info. you provided about fighting the ticket. It was fought and won. Lots of pictures were presented to prove my case. I think some of these warriorsare aware that these ramp tickets are illegal but continue to write it if they can get away with it. We should all continue to fight for what we believe in

generous offer! I could have used that offer last month however. I just fought a ticket this week for parking in a crosswalk (no reduction possible on that type of ticket) and beat it - I learned some interesting stuff in the process and I also taped the encounter with the judge. I opted to go in person because my last attempt to fight a ticket was by mail and they never "received" my letter, the photos, etc. So I didn't trust the fight-by-mail business. According to this judge, if any part of your car is over the place where the line begins (the line of the crosswalk), for example, a few inches of your fender, it's a violation. That sounds really unreasonable to me. Is that really true? In my case, my car was over the "stop line" but not over the crosswalk line, so the Parking Brownie made an error.

Thanks so much for sharing your very interesting story. Unfortunately, NYC parking rules took a page out of the football rule book. 
 
If you "cross the plane" of a crosswalk line, it constitutes a parking violation. So, the judge did state the rule as written. 
 
I've helped our community with similar stories. Warrior issues ticket when you park between the stop line and the cross walk. It is an old, devious, trick. Bad warrior!

Keep fighting the good fight. 
 
P.S. I always ask our clients to send their defense letters/affidavits by certified mail, return receipt requested. It solves the "we didn't receive your defense papers tall tale." Ca-ching.

You said that the settlement program was replaced by a Reduction program but when i went down to a hearing no one knew what i was talking about and there is nothing explaining how it works on the NYC finance website. Can you explain how it works and where you got the info from. Is it somewhere posted or in writing? Thanks

My source was the DOF website. Here's the quotation: 
 
"Settlement Program 
 
The Settlement Program is ending January 31, 2012. If you wish to pay the settlement amount, Finance must receive your payment by January 31, 2012, even if it is less than 30 days from the time you agree to this settlement. The fastest way to pay is online. 
 
The New York City Department of Finance has instituted a Reduced Fine Program (Settlement Program). An offer of reduction is extended for certain violations prior to a hearing with an Administrative Law Judge. If a reduction is accepted the respondent waives their right to a hearing and appeal. Participation in this program is not mandatory. 
 
You will receive the judge's decision at the conclusion of an in-person hearing. If you request a hearing by mail or via the web, the decision will take approximately 75 days."

I'm wondering now whether the little box inserted above the Fine Reduction Program was really intended to override the information about the Fine Reduction Program below the box. 
 
It's just like the DOF to add confusion to injury. 
 
I'm going to publish a blog post on this tomorrow.

I wish I'd had known about the free Friday till sunset. I'm fighting a safety zone violation. I'll let you know the results of the mail plea. I'm in Hartford CT.
