Please do not try this on your own without the assistance of an expert. It's too dangerous. Our terrific client was so angry about the injustice of being pummeled with a NYC parking ticket for double parking while he stopped for twenty seconds to drop off his wife, he decided to fight the parking ticket, period!

I explained at the present time, most people, parking ticket judges and experts argue double parking is always prohibited.

Our client asked, "What do I believe?"

I believe the double parking rule is a no standing/no parking violation. Stop, drop and go is a defense to all no standing/no parking violations. Ergo, since you stopped temporarily to drop off your wife, I do not believe you are guilty of double parking.

The big but, is your chances of beating a parking ticket for double parking is like finding the proverbial needle in the hay stack. You have an option to apply for a reduced fine. You may be tilting at windmills.

He tilted and won

The decision to fight a NYC parking ticket is rarely about the money. It is about principles, injustice, and fighting to take control of the highways of NYC from the Darth Vader's. Our client was right, and fought to prove it.

Kudos to the parking ticket judge who did what he thought was right, didn't succumb to the DOF pressures, and dismissed the parking ticket.

This is why we should always appeal. Hoorah! I suggest he write letters to the papers. We need as much publicity as we can get to combat the insanity.

Yes. It really felt good to fight a double parking ticket and win. I loved the fact the judge had the courage to make the right decision, despite the pressure to find people guilty.

I recieved a parking ticket for double parking in January 2010. I just looked on the web site yesterday 8/11/10 to check on my other ticket and thats when I saw the 2nd ticket. I was doubled park but I was in the car witing for a parking space. I saw the traffic cop pass by but they never said anything to me. The lady left the spot then I parked my car in a legal space and went to my son's doctor appointment. I returned to my car and went about my business. They had never placed a ticket on my caround my car cause I had to walk around my car to put the babby and other things in. In other words, the traffic cop gave me the ticket after I parked my car. How do I fight this ticket. Especially since its been so long.

Thanks for taking your valuable time to visit our website and post a great comment and question. I am very sorry to say, if your parking ticket is in judgment, there is very little you can do. 
 
You may submit a "Request for a Hearing after Judgment." Here's the link...

You must prove excusable neglect and a substantial defense to the alleged parking crime. The form itself contains some examples of what constitutes "excusable neglect." Believe it or not, double parking while waiting for a driver to vacate a space is considered by the parking ticket judges a violation of the rule against double parking. 
 
This is going to be a tough parking ticket to beat.

I just received a double parking ticket on Steinway Street in Astoria. I was dropping off a passenger to go to a doctor's office for an appointment. A cop then approached my car and gave me a ticket for double parkng. How can I beat this ticket? Can I beat it by hearing by mail, I can not afford to take the time off work to go in person.

I received a double parking ticket. I was double parked during street cleaning on the side of the street not being cleaned. Cleaning ended at 11:00am, my ticket is pegged at 11:02am, I guess my cellphone was several minutes off since I thought I would be arriving before 11am. Would you say the 5 minute grace period can be used as any sort of defense? I was up on W 130th St. and Lenox and I even asked a crossing guard AND a Con Edison guy if it was ok to double park before doing so and she said people did it all the time, though I know now after doing my research that it is technically illegal despite some ticketers looking the other way. It's really frustrating because I would like the city to take a stand and hold it re: double parking on street cleaning days, it's unfair for police officers through neglect or compassion or whatever to allow you to believe it's legal when in reality its illegal. A perfect setup for that day when lady cop gets her period.  
In addition, in the "Make" section of my ticket, it says "NS" not "N/S". Does that qualify as any kind of defect..?

I got a double parking ticked while I was parked in front of my building for two minutes. I was picking up passengers (my wife and my toddler son). it took no more than two minutes to go up and help my wife bring down our son, stroller, bags. 
The legal alternative would be to go find a legal parking spot, which in this neighborhood usually means up to 30 min driving around and finding a spot several blocks away. Of course I'm not going to walk that far with my kid in the cold, when I just need to park of the building for 2 minutes. Although I have no legal grounds for this parking, does common sense play any judgment if I fight this ticket? Do I stand any chance of winning?

I would have done exactly what you did. Unfortunately, we both would get a parking ticket. 
 
Many judges believe double parking is always illegal for private vehicles. There is, however, a minority view (me included) that passionately believes you can double park while dropping off or picking up a passenger, and skedaddle.  
 
But, under no circumstances can you leave your vehicle, even for a NYC minute. You can't even walk your 102 year old Aunt Tillie to the door.

Check for mistakes on the front of your ticket. If none, you may wish to apply for a reduced fine (while they last).

Larry, I was given a double parking ticked while dropping off my 2 year old at my in-laws. It took less than two minutes. However, I did leave my car to walk her to the door (steps away from the vehicle). Am I SOL for leaving the vehicle?

But, you're not done yet.  
 
Now, you know you're right, and you're going to fight this evil, orange, epistle.  
 
Next step is to present the proper proof, properly. Keep in mind it is not easy to prove a negative. 
 
One of my favorite offers of proof when the location doesn't exist is to send a letter, addressed to "occupant" at the non-existent address. Make sure you write your return address on the envelope. 
 
The US Postal Service will help you prove your case. You will get your letter back marked unable to deliver, or some such marking. 
 
Submit the returned envelope along with your defense letter, and you are well on your way to V-I-C-T-O-R-Y! 
 
Let us know the outcome.

i got a double parking ticket,yesturday sunday january 15.Iwas in back of my car fixing the jeep trunk for space to put a little table in.i never left my car un attendant and all of a sudden.i see this traffic cop giving a ticket..can i beat this unfair ticket of 115 dollars. when Itold her that i was here she says its to late...that she didnt see me...she had some nerve..can i beat this ticket by mail..or is it better un person

I am sorry for your NYC parking ticket pain. 
 
Unfortunately, the only defense to double parking is for the purpose of stopping temporarily to drop-off, or pick-up a passenger (This is the minority view...The majority view is a "pass" vehicle can never double-park). 
 
You may wish to check the front of your parking ticket for mistakes. If none, please apply for fine settlement to reduce this nasty fine, and pay before the settlement program ends on January 31, 2012.
