Improper Display of Inspection Sticker: A Parking Ticket you can Beat

 

Our friends and clients ask our advice about how to beat a NYCparking ticket dispute parking ticket for a violation of 4-08 (j)(6): "Vehicles must display valid inspection sticker"

First, let's take a look at the language of the rule.

"No person shall stand or park a vehicle bearing New York plates unless it is properly inspected and properly displays a current inspection sticker or certificate, in accordance with Section 306(b) of the Vehicle and Traffic Law or unless it bears New York dealer or transporter plates pursuant to Section 415 of the Vehicle and Traffic Law"

What are some examples of improper display of an inspection sticker?

  • Placing your inspection sticker on the dashboard of your vehicle when it falls off
  • Failing to affix the ends of your inspection sticker when they begin to detach from your windshield because the glue doesn't stick
  • Placing your sticker above or below your registration sticker
How do I replace an inspection sticker? (The following information is taken directly from the NY DMV website)

parking ticket disputeIf the sticker did not remain attached to your windshield, you can attach the sticker to the windshield again with clear tape or a small amount of clear adhesive. Remember that an inspection station must be able to remove the sticker during your next inspection.

If your sticker is not usable or you do not have the original inspection sticker, you can have your vehicle re-inspected or you can follow the instructions below.

Send a request for replacement to the DMV, indicate the reason for the replacement, and include either a copy of your inspection receipt OR the following information:

  • the serial number of the original inspection sticker, if available, and
  • the year and make of the vehicle, and
  • the vehicle plate number, and
  • the odometer reading at the time of the last inspection, and
  • the date of the last inspection, and
  • your daytime phone number.

The fee for the replacement is $2. (See the note below about known defects in some 2010 stickers.)

Send the required items and a personal check or money order payable to "Commissioner of Motor Vehicles" to:

P.O. Box 2700-ESP
Albany, NY 12220-0700

Note about 2010 Stickers with a Known Defect:  The DMV knows of a defect in some inspection stickers that have a 2010 expiration date. These stickers are gray in color. The replacement fee will be waived if you have one of these stickers that does not correctly adhere to your windshield. In your request for a replacement sticker, indicate that this replacement is for a "defective sticker". Read the DMV press release about the inspection sticker and vehicle registration issues."

Commentary:

As so often is the case, some parking ticket warriors shoot first, and give you the honor of fighting an unwarranted NYC parking ticket later.  Remember, when a warrior issues a parking ticket for "improper..." he/she must:

  • insert the reason it is improper on the front of your parking ticket
  • Your inspection sticker number
  • Date of expiration

If not, you are entitled to a dismissal of your parking ticket upon application.

I recommend taking immediate action when your inspection sticker becomes loose. Follow the instructions issued by the NY DMV to reattach or replace your inspection sticker. If you are issued a parking ticket, you have a strong defense by following the published advice of the DMV. The worst you can do is place the sticker on your dashboard. Bad idea. Don't do it!

How relevant to my situation... 
 
Here's a good one for you - can I fight this?  
 
Today, I got a ticket for "Improper Display of Reg Sticker" and the comments state: "Stkr on right side of windshld".  
 
 
 
My NYS reg and inspection stickers are on the DRIVERS side, however, my registration is on the outside edge, and the inspection on the inside. I do not recall how long they've been like that as I have been registered in NYS for over TWO YEARS without a problem. I also have an old DC inspection sticker on the passenger side.  
 
 
 
Is that what the ticket is for? Which side do these guys call the "right" side (drivers or passengers)? Can I fight it because I have no idea what the comment means? The RIGHT side to the cop would be the drivers side. And there's nothing in the law that says you can't have a sticker from a previous state if your current NYS stuff is up to date.

It has been raining NYC parking tickets the past few months. Amazing. 
 
I think the best answer to give you guys is the above image of a windshield with reg/inspection stickers is the correct way to display these items. If your reg/inspection sticker match the above image, you are right! 
 
If not, you may wish to apply for a fine reduction. By the way, my take on the out-of-state inspection sticker is it should not have a bearing on the outcome of your case(s). 
 
If you fight your tickets, submit photographs showing how the stickers were displayed.

NYC are nothing but racist crooks toward white people. I have had problems with these idiots for over 3 years. If you go to court and fight it you will win. If you mail in photo evidence they decline it anyway.

I am wondering if I get this ticket dismissed? 
 
I got the ticket for violation "improper stkr safety Only (j)(6)" but in the Complainant's Comments: "NYMA Reg".  
 
You stated that the ticket must informed what the problem is when the violation contained the word "improper" but if the comments field stated registration sticker and nothing pertaining to the inspection ticket; could the ticket be dismissed?

What are your thoughts on getting a ticket dismissed if your windshield is cracked, you're having it replaced and you intend to do it within days of the old sticker expiring? I got a ticket for "improper display" by putting it on the dashboard in lieu of placing it on cracked glass.

Fella I know came to NY 05/23/10. Next day went to DMV, got his NYS driver's license & temp inspection sticker. He didn't know it was only good for 10 days. On 05/28 while in NYC he got 2 tickets --"Reg Sticker Missing (NYS j3)and "Insp Sticker Missing" (NYS j6), $65 each. BOTH the inspection sticker and Registration were on his window! Oh, there's an $85 state surchange for each. Have they gone nutsy in NYC?

Reply to Larry: yes, I'm fighting the 2 NYC tickets for the young man who recently came from China.  
 
 
 
Since last post learned he got a $100 "No Inspection" ticket in White Plains. Yesterday went to WP City Court. Paid only $20. I'd say it was fair considering he WAS late with the inspection -- by one day! But no surcharge like in NYC. 
 
Another person with same charge had to pay $100+$85 surcharge cuz he had no proof of anything. What a rip-off.

I received 2 tickets referencing the same code, (registration was on my dash) here is a bit of research I have done, I am requesting dismissal based the below. 
 
1.No where in the section (j)(3) of NYC traffic rules, does it state any definition of “proper” display yet In other sections like (j)(2), it goes into specifics of how much distance the license plate needs to be from the ground, (j)(3) is not this specific. If it is in violation of any other NY state rules or guidelines then that should have been referenced as such, but the ticket specifically states Sect. 4-08 of NYC traffic rules (j)(3)and nothing else. 
 
2. spelling on the ticket is wrong "impropr dsply of reg stckr" legal documents should be spelled correctly and improper spelling shows a disrespect to the English language and laws. 
 
I will let you know how it goes. 
 
 
 
BTW I disputed another parking ticket via the NYC website "hearing by web", even though I was guilty and had no defense, it systematically offered me a reduction of about 1/3 the cost of the ticket. Reduce the ticket , then in a second transaction to pay , but you need to change the amount to the reduced amount. (print everything as proof)

Thanks for taking the time and sharing the details of your dispute. I respectfully offer some suggestions. I hope you don't mind. 
 
If you are issued two parking tickets for improper registration within 24 hours of one and other, the judge will generally dismiss the second parking ticket.  
 
Spelling doesn't count. Pointing it out will always make the judge angry. Like waving the proverbial red flag in front of a bull. 
 
Arguing about the construction of a parking rule will always, absolutely, every time fall on deaf ears. The PVB must follow the rule as written. 
 
Did you check for mistakes on the front of the ticket?  
 
The warrior must insert the reason the registration was displayed "improperly." If not, you win. 
 
If there are no mistakes, and the warrior inserted words to the effect "registration on dash," you may have been better served by applying for the reduced fine for the first ticket, and asking the judge to dismiss the second ticket.

I received a ticket stating 'impropr dsply of reg stckr' with comment: 'sticker on dash'. 
Are the following reasons grounds for dismissal: 
1. Faulty glue on the sticker. 
2. I only drive my car once or twice a week. Therefore, I only noticed that the sticker fell on the dash when I attempted to drive the car but by then I have already got the ticket.

I got a parking ticket on July 7 for "Inspection Stick Expired (NYS) (j) (6). I had paid my muni-meter fee, but they slapped me with a $65 ticket for the lapse in the inspection. 
 
 
 
However, I was on my way to go get my motorcycle inspected, after lunch (which is why I was parking). Isn't that a defense for at least a reduction? Or should I just pay the $65?

I got two tickets on separate days, the first was for "Insp Sticker Expired (NYS) (j)(6)", with a "Complainant's Comment" noting my Inspection # and Expiration Date, at the bottom of the ticket. 
 
After getting the ticket and realizing it needed to be inspected, I went to get the inspection done, but failed the test the first time. 
 
The repair shop scraped off the expired inspection sticker, and put a 10-Day Inspection Extension printout on my dashboard, and said I'm good for 10 days. 
 
A few days later, a 'Warrior' gave me a ticket for "Insp Sticker Missing (NYS) (j)(6)", without any notes under the "Complainant's Comments" section of the ticket. 
 
The warrior didn't bother to look at the inspection extension paper on the dashboard, or didn't care that I had an extension. 
 
I would fight the 2nd ticket with the inpsection extension paper, but the problem is that the repair shop that inspected my car the 2nd time (Which passed), threw out that printout, and put a new inpsection sticker on my windshield. 
 
Now, I don't have that extension paper as evidence anymore. 
 
What can I do about these two tickets? Are they both hopeless, or can the 2nd one still be fought? 
 
Please note the following... 
 
1. Although both tickets are for "Section 4-08 (NYS) (j)(6)" with "Violation Code 71", one ticket states "Insp Sticker Expired", whereas the other ticket says "Insp Sticker Missing". 
 
2. One ticket notes the Inspection sticker # and Expiration, whereas the other ticket's comment section is left blank. 
 
3. I just noticed that both tickets were written by the same warrior, but on different days.

Apparently, my reg sticker fell of today and I recieved two tickets. One saying "Impropr Dsply of Reg Stckr (j)(3)" with comments "Sticker on Dash" and the other saying "Reg Stkr Mutilated (j)(4)" with comment "Sticker Discolored." What is infuriating about this is the glue stopped working and the sticker fell onto the dash exactly below the windshield where it was attached and the "mutilation" is from the bits of glue and sticker that stayed on the windshield. Any advice on how to beat these two $65 tickets?

Amazing. 
But, here's the scoop. 
Generally, parking ticket judges are inclined to dismiss a second "status" violation if issued within one business day of the first "status" violation. Registration violations are status violations. 
 
First, I would check both tickets for mistakes. If a required element is omitted, misdescribed or illegible, you win upon application. If no mistakes, here are your options: 
 
1. Fight both tickets. Tell your story the same way you commented on our blog. The judge should dismiss the second ticket and MAY dismiss the first ticket. Everyone knows about the problem with the glue. When did your parking ticket fall off? This is important because if not the same day as the ticket was issued, a judge will not dismiss the first ticket. 
 
2. Apply for a reduction of the first parking ticket and fight the second parking ticket. 
 
Let us know your decision.

Hi Larry, 
I received a ticket for $65 at 7:30 am on 7/10/10 for 'impropr dsply of reg stckr (j)(3) with comment: 'Sticker on dash'. I sent back the ticket, within 30 days, for 'hearing by mail' with the following '8.other defenses': 'When I left the car on 7/6/10 the registration sticker was adhered to the windshield. When I came back to the car on 7/7/10 the sticker was laying on the dash. The sticker fell off during my absence. There must be something wrong with the adhesiveness of the sticker'.  
In the meantime a penalty of $10 was added to the original summons. So the total summons is now $75. Then, I received a letter offering either a reduction to $43 without a judge hearing or a judge hearing (which may either result in dismissing the summons or paying the full balance (I assume $75). 
Should I take the reduction or allow a judge to review my case?  
Do you think the judge will dismiss the summons?

Great question.  
You may wish to accept the offer of a reduced fine. It has been our experience when you leave the fallen sticker on your dashboard for more than one day, judges are not inclined to dismiss your parking ticket; even if the glue stopped gluing. 
 
The DMV suggests either securely tape the sticker back on the windshield with transparent tape; and/or order a new sticker.

Welcome. Thanks for joining the conversation and posing a great question. You did the right thing in taping back your registration to the windshield. However, I'm afraid upside-down is a technical violation.  
 
I think a judge is inclined to follow the technical letter of the rule, rather than the spirit. You may wish to apply for/accept a reduced fine. 
 
(Color is NOT a required element. The wrong color does not entitle you to a dismissal of your ticket upon application).

I paid the registration fee a month ahead of time and have a canceled check to prove it. Unfortunately the sticker didn't come in time. 
 
I received two Reg. Sticker Expired (NYS) (j) (3) tickets. The second time the car was towed! I had no other pending history. 
 
I brought the canceled checks with the tickets to the court house and the judge insisted that it doesn't matter. I should of taken the car off the street. Was he right? Or should I appeal?

Thanks for sharing your sad story, which could happen to any of us. You would think sending your check to renew your sticker one month prior to the expiration date is more than sufficient time to receive your new sticker by return mail. 
 
By any chance were the two parking tickets issued in the same day?  
 
If not, and there were no mistakes on the front of the parking ticket, I'm afraid there are no provisions in the rules to give you relief from the tickets. I also checked with the DMV, and couldn't find anything to help your cause. 
 
You may choose to appeal anyway, since you have nothing to lose; except your valuable time. The issues are how much time is enough time?; and is the expectation you are supposed to visit a local DMV office to order a "duplicate" if your sticker hasn't arrived a day or so before the expiration date?

Received a ticket while in store parking lot for Reg sticker unread. 
 
Only a little bit of the top was not adhered to windshield. You could still read the expiration date. Why a ticket if can see date?

Thanks for taking your valuable time visiting our website and posing a great question. The warrior's notation on your parking ticket is confusing. My guess is the warrior is referring to the ability of his/her "scanning device" to "read" your registration.  
 
I don't believe he/she is referring to read with one's eyes. 
 
You are between a rock and a warrior on this one. It is going to be tough to persuade a parking ticket judge the warrior was being untruthful about his "scanning device." You may wish to apply for a reduced fine.

Same old situation but a slightly different question. I received a ticket for $65 at 2:12 pm last Saturday for 'impropr dsply of reg stckr (j)(3) with comment: 'Sticker on dash' and 'reg on dash'. As I remembered, the sticker was good when I left the car early in the morning. It seems very likely that the glue stopped working in the afternoon. The ticket says 'N/A' for "Date/Time 1st observed (of offense)".  
 
Since you suggest the judge tends to dismiss the ticket if the sticker falls off within one day, shall I use this argument to fight back? Especially there is no clear evidence from the ticket that the sticker has been fallen off for over one day, as the 'date/time 1st observed' is 'N/A'.

Hello here is my situation. Any help would be appreciated.  
 
I got a ticket for expired inspection but it was not expired. My inspection expires nov 2010 but the traffic officer wrote it expired april 2010 because the "nov" part of the sticker fell on top of april so he thought i was covering it. Now i dont have the sticker but i have the serial number. How can i proove its real expiration date which is november.

Great question. You may be able to obtain a copy of your old registration from the DMV. I would submit a copy of your old registration (if obtainable) along with a photograph of your new registration sticker attached to your windshield. Please be sure to also include a photograph showing your sticker attached properly to the windshield and license plate. 
 
A word of caution...Any time you step outside the normal proof the judge expects to receive, you can't be sure of the outcome. Normally, the proper proof is a photograph of your sticker, showing date of expiration if a NY registered vehicle, and a photo of your car, plate and registration. 
 
If out-of-state vehicle, than the plate attached to the car, with a close up of the expiration date on the plate. Or, if reg is attached to windshield, the photograph of windshield reg/and license plate, with a close up.

I have received the same ticket twice by the same officer. The first time I received the ticket I was able to have it dismissed because the ticket noted the incorrect color of my car. I recently received another ticket for the same issue: "Mutilated Inspection Sticker". My inspection sticker was not mutilated. The sticker fell off and I applied transparent tape to affix it to my window as advised by the DMV. Three days later I decided to get my car reinspected because the inspection would have expired this month and so that I would have a sticker without the tape. How should I go about fighting this ticket? Any suggestions is appreciated.

On February 1, 2011, I received a ticket for an expired inspection...Indeed, my inspection had expired the day before, January 31st, but I did not realize it! 
 
As you know, at the end of January, we had a lot of snow in NY and my car was buried in for about 10 days. I figured, I'd wait until the snow melts a little before trying to drive it out and park it in my garage.  
 
I cannot tell you my anger on Feb 1st when I walked by my car and I saw that the ticket. An agent went through the trouble of climbing over a snow bank, cleaning the 3-4 inches of snow from the windshield so he can scan/see the inspection sticker! Then, he cleaned another portion of the windshield so he can put the ticket under the wipers! 
 
I could not believe how aggressive these people are!  
 
As I said, I do have a garage close by and a Lease doc to prove it...I just could not get to it because I was afraid of getting stuck in the deep snow the days prior to getting the summons. 
 
Can I fight this? Better off, is it worth it or a waste of time?

I received a ticket for a mutilated inspection sticker. My sticker was torn from when I had my windshield replaced. I have since gotten a new inspection. Any way to beat this ticket or should I accept the reduced fine?

Good afternoon. I'm afraid "mutilation" is in the eye of the beholder. If your sticker was torn, you may wish to accept a reduced fine. 
 
The fact you replaced your sticker is not a defense to the offense.

Hi, I received two 1-Impropr Dsply of Reg Stcker (j)(3) - Sticker on Dash, 2-Impropr Dsply of Reg Stckr (j)(3) - new stkr on dash, expired stkr on windshield Sticker on Dash - approximately 1 week apart. There are no alternate street parking on the street that my car was parked and I don't drive everyday. So I didn't know that I couldn't leave the sticker on the dash or rec'd parking tickets. (I left it there because I didn't have time to get my car inspected and the inspection doesn't expire for another month.) 
 
 
 
Should I pay the reduced fine on the first ticket (#775777349-0)and fight the second (#74518407-8)?

Good morning. Good question. I am sorry to report the custom at the PVB is to dismiss a second status violation ticket if issued within 24 hours of the first status violation ticket. 
 
You may wish to check the front of the tickets for omitted, misdescribed, or illegible required elements, such as, make, expiration date, body type, plate type, sticker number, sticker expiration date. 
 
If so, you win upon application. If not, you may wish to apply for the reduced fine on both tickets.

I have about 20 tickets for Insp Sticker Missing (NYS) (j)(6). However my inspection sticker is not missing. It is torn. There are NO notes in the comments section. 
 
 
 
In the middle of all the tickets is one that states my correct offense: Inspection Sticker Mutilated (j)(7). In the comment section the warrior notes "sticker torn". 
 
 
 
Can I dispute the fact that they gave me a ticket for the wrong violation? Seeing as though my inspection sticker is mutilated (TORN) not missing.  
 
 
 
One warrior even gave me a ticket for Inspection sticker expired. But how is this possible if it's missing the day before and the day after? 
 
 
 
I really can't afford to pay these tickets and lose my car. Please help me.

I'm happy to announce that I beat all 24 tickets! The judge said that my argument was validated by the ticket I used as my evidence which stated that my inspection sticker was mutilated not missing like the other 25 tickets stated. 
 
In the comments section it stated that the ticket was torn but listed the the exp date. This date has already passed. But the ticket issued on the previous day stated that my inspection sticker was missing. If it was missing on day 1 how did I get an expired inspection sticker on day 2. 
 
I'm so relieved!

I received a ticket for 4-08 (j) (3) - Registration sticker. The parking officer listed in the comments section that my NYS registration was missing. Technically, it wasn't missing, it was on the rear dash, totally visible. Is the misdescription of an element a defense?

By Rule, a registration sticker is required to be stuck on the windshield of a vehicle. Otherwise, it is considered missing. Sorry.

Good morning. Amazing. What a ridiculous parking ticket. If it were me, I'd fight this ticket. Were there any comments inserted by the parking ticket warrior on your ticket? If so, what were they? 
 
Submit photographs and indicate failure to explain how the registration was improperly displayed. 
 
Your other option, of course, is to apply for a reduced fine.  
 
This one really makes me mad.

Every year I renew my car's inspections tags in April. I have the paperwork documenting that its always in the same week period for the past 3 years.  
 
Last year my sticker was falling off so I went in February to get a new sticker. The sticker they gave me was for an March 1 expiration not the year that I'd paid for. Though my receipt says the ticket expires on April 28th 2011. I lost two months to a typo and now got two tickets in 24 hours for an expired inspection sticker. I've already renewed the sticker but how can I fight the tickets?

Many of the parking ticket judges will dismiss a second parking ticket issued for expired sticker if issued within 24 hours of the first ticket. There are other judges that will dismiss the second ticket if issue any time during the same day as the first ticket. 
 
I'm not 100% sure I'm following your story; but, the bottom line is you must have a valid sticker on you windshield. Your options are to apply for a reduced fine on the first ticket; or fight the first ticket and submitting your receipt as proof. 
 
As far as the second ticket, fight!

Hi Larry, 
I received a ticket for registration sticker missing and for inspection sticker expired at the same time. I have proof that my registration was properly completed at that time -- should I submit this proof along with a photo of my car that shows the sticker properly attached to my windshield? Will that be enough to get this ticket off? 
 
As for the inspection -- I received a ticket for an expired inspection on May 2nd and paid the settlement fee. I got it inspected May 4th and failed the safety inspection due to my tires. I received an Inspection Receipt and the shop told me that I could show it to cops for ten days incase they asked me about it and I should be fine. I got a ticket on May 11 when I visited NYC overnight . Can I submit as a defense the Inspection Receipt from May 4th, or should I take the settlement offer?

Good morning. Great questions. It is not that easy to beat the registration sticker missing ticket, UNLESS you can prove it was attached to your windshield on a date/time prior to the issuance of your parking ticket. If not, you may wish to take the reduction. 
 
When you're right_FIGHT! Is your car registered in NY? What sticker was on your windshield when you were issued the ticket on May 11th?

If you get an inspection and it fails for safety because the tires are not good, and they give you a printout as proof of the temporary inspection, will that be a valid defense if you receive a ticket within 10 days of that temporary inspection?

I just put my registration sticker on the far lower left hand corner of my windsheild and went to get an inspection.  
The inspector said he would put the inspection sicker above the registration sticker.  
So, am I going to get into trouble now?  
Will I be able to get either off intact to move them?

Matt, it really depends on the warrior whether or not a ticket is issued. 
 
I wouldn't try to change the location. Too risky. I would let it be for now. Even if a warrior issues a ticket for the wrong location on the windshield of your stickers, I can't imagine a judge finding you guilty because both current stickers are, in fact, displayed on the windshield. 
 
Tough call.

The Problem:  
 
 
 
I have received dozens of tickets for “Inspection Sticker Expired/ Missing” since registering my car as a new resident in September of last year because there is a conflict between the NY State statute (section 3, article 105b—??) and the municipality’s DMV online, non-attorney consumer information site (http://www.nydmv.state.ny.us/vehsafe.htm), as excerpted here: 
 
 
 
“Department of Motor Vehicles 
 
Vehicle Safety, Inspection, Repairs and Dealers  
 
If you become a resident of NYS and register your vehicle in NYS, your out-of-state inspection remains valid. The out-of-state certificate or inspection sticker issued in your name is valid until it expires, or for one year after the vehicle is registered in NYS, whichever comes first. When your out-of-state inspection expires, you must get the vehicle inspected in NYS.”  
 
My attorney says the precedent upholds the resident’s responsibility for knowing/ adhering to state law, regardless of what the website says, as a way to protect taxpayers from these kinds of lawsuits. I now doubt I will be reimbursed for the cost of being towed (now four times, in excess of $3,500); that they will expunge the “driving w/ a suspended license charge; or that they will agree to dismiss the current $1,200 in tickets still on my record (now being disputed by my attorney and not yet in judgment).  
 
 
 
 
 
The Details: 
 
 
 
I dutifully contested the first few tickets in writing (2nd attachment), with photo evidence (1st attachment), as instructed on the reverse of each ticket. Only one was responded to with an offer to pay a lesser amount or continue to await a written verdict on the hearing by mail I requested. No verdict came. I responded in-kind to two or three subsequent tickets with a photocopy of the same letter, but admittedly; I work late, travel frequently and quite frankly, have more gratifying things to do than resending excerpts of NY traffic law to a department responsible for ticketing vehicles on behalf of this city.  
 
Here’s the absolute worst part! On the 19th of June, I was involved in a minor fender bender that ended in my ARREST for driving with a license I was theretofore unaware had been suspended—and just that day, according to arresting officer Perez of the NYPD—due to “unanswered summons,” for an offense no one in the 20th Precinct was ever able to provide details on. 
 
After an hour in a holding cell, and a desk warrant to appear before a municipal judge (for what my attorney discovered was the result of my failure to pay an illegitimate ticket incurred while driving in LI City, Queens), I can look forward to Geico either dropping me or raising my rates higher than the Empire State Building. Then, I’ll have the pleasure of navigating another labyrinth of municipal mayhem trying to remove an unduly issued suspended license charge from my driving record. 
 
I attended the desk warrant hearing on the 21st of last month, where they informed me that they were not informed enough to proceed with my hearing and that if I didn’t receive another hearing date in 90 days, to call the DA and inquire whether they still intend to prosecute (which they won’t), at which time I can request my license back. Ultimately, I went to the DMV, paid $70 to contest the “unanswered summons” plus a $40 bond, and my license was reinstated pending a hearing in late August. 
 
At this point, I’m nearly certifiable, exasperated and very pissed off by what appears to be a systemically corrupt ticketing and adjudication process resulting in the virtual extortion of NY City vehicle owners for the non-payment of parking fines that were incorrectly issued and without placing any accountability on itself for their lack of response to hearing-by-mail contentions of the initial citations.

I received 2 tickets today: Registration Sticker Missing & Inspection Sticker Missing.  
 
I have the Registration Sticker there, and there is no problem with it. (I took a photo and can send to them). But the car has not been inspected in NY because I just bought it. It's NJ inspection cert is still valid.  
 
I was told by a friend that actually you don't need to get your vehicle inspected in NY the old inspection cert is expired - was he wrong?

I received a ticket for inspection expired today afternoon, I didn't even realized that it expired. I went online to see if I can pay the fee but found out that I have three other tickets for the same violation earlier this week. 
 
I have never seen these other tickets on my windshield. The first ticket was on the 13th, the 16th then the 17th and lastly the 21st (the ticket I found today). So now, I am looking at 4 tickets and perhaps more that I do not know of. And at $65 a piece- is there any way for me to fight this successfully? If I received the first ticket then none of those others would exist. Is there anyway for me to fight some of these tickets successfully?

My vehicle is registered and inspected in Vermont. I was in New York, and while parked I received a ticket for expired inspection. to be honest the inspection was expired but the officer wrote that it had been expired for over a year (basically wrote the wrong exp date on the ticket). My first question is weather it is legal for someone from NY state to write a ticket enforcing Vermont state laws? can they ticket me for an expired inspection from another state. And my other question is since the officer wrote the ticket incorrectly is there any way to get out of it because of a technicality? I called the number on the ticket and asked if they could legally ticket someone from out of state for this and they said they didn't know and it was up to me to show that it was not legal. do you have any ideas for that?

I am a former NYC resident who recently moved to Delaware. I had switched my car registration from NY to DE, but I forgot to remove the NY registration and inspection stickers from my windshield. 
 
I made a visited NYC the other week and got a ticketed for having an expired NYC inspection. I submitted evidence for a hearing that my car displayed DE plates and was no longer registered with NY, but they found me guilty anyway. 
 
The decision stated "Claim that vehicle was registered in another state does not excuse the violation when a vehicle displaying either a New York plate or registration sticker must display the current New York inspection sticker while vehicle is in public view." 
 
However, according to the letter of the law, 4-08(j)(6) only mentions the display of NY plates and does not mention the display of NY registration stickers. 
 
Ugh, do I have any recourse?

What a horror story! All because of the bad behavior of the NYC DOF. What action would I take: 
 
1. I would report this to my council person 
 
2. Contact Mark Morales, a writer for the NY Daily News (Queens beat). You may wish to mention Larry from New York Parking Ticket recommended I contact you, and tell him your story. Hopefully, he runs with it 
 
3. I am going to post a blog about it. 
 
Your terrible tale teaches us all a valuable lesson--It is not enough to dispute your ticket. It is essential to affirmatively follow its progress through the system to make sure your dispute remains on track.

Here's the rules regarding current out-of-state inspection stickers for new residents of NYC: 
 
1. "If you become a resident of NYS and register your vehicle in NYS, your out-of-state inspection remains valid. The out-of-state certificate or inspection sticker issued in your name is valid until it expires, or for one year after the vehicle is registered in NYS, whichever comes first. When your out-of-state inspection expires, you must get the vehicle inspected in NYS." NY DMV 
 
2. As you aptly stated in your email, you were charged with a violation of (j)(6) which states: 
Vehicles must display valid inspection sticker. No person shall stand or park a vehicle bearing NY plates unless it is properly inspected and properly displays a current inspection sticker or certificate, in accordance with Section 306(b) of the Vehicle and Traffic Law or unless it bears NY dealer of transporter plates pursuant to Section 415 of the Vehicle and Traffic Law. Section 306(b) of the Vehicle and Traffic Law

Please check the front of each parking ticket for mistakes. If any required elements are omitted, misdescribed, or illegible, you win upon application. 
 
Required elements are model, registration expiration date, plate type, body type, date/time of occurrence...In addition the registration sticker number, and date of expiration must correct appear in the comments portion of your ticket. 
 
If none of the parking tickets were issued within 24 hours of the other, and there were no mistakes, you may wish to apply for a reduced fine.

Plus, the inspection sticker expiration date and number must be entered correctly on a parking ticket for a vehicle bearing NY plates.  
 
You may wish to fight your parking ticket by mail (certified, return receipt requested)to the address on the back of the ticket.  
 
Please present the proper proof, properly. It consists of:  
 
1. A copy of your vehicle registration  
2. Some photographs of your vehicle bearing VT plates.

This is an absolute joke. A great example the pursuit of money absolutely trumps justice. 
 
You have a right to appeal this inane decision within 30 days of its embarrassing entry. You must persuade the appeals panel the original judge made a mistake of law or fact.  
 
(J)(6) only covers vehicles bearing NY plates!! As you correctly stated. If your vehicle is registered in De, and displays De plates, you were charged with with a parking crime that does not apply to your vehicle. 
 
You are required to submit an appeals form. I suggest attaching an addendum to the form explaining the basis for your appeal (Keep it simple...the original judge made a mistake of law because....)

Hi, thanks for an informative site. I checked the previous posts but didn't find anything exactly like my issue. Last week I received a NYC parking summons for "Insp Sticker Expired (NYS) (j)(6)" The complainant's comments stated the insp # and "Exp: 02/28/12". Here's my question: if the inspection expires on the last day of the month, then this is incorrect information as 2012 is a leap year and February has 29 days.Do you think that this would be dismissed when I challenge it? Also, I'm able to (but not too happy about) going to fight this in person, but do you think this can be done by mail? Thanks.

Hi Larry and Thank you for the informative site that contains such a breadth of useful information. Thanks to your site, I recently had a ticket for No Front Plate (j)(2) dismissed.  
 
I successfully had this ticket dismissed earlier this week because the Place of Occurrence indicated on the ticket does not exist in Queens County! Hence a required element (place of occurrence) was misdescribed and upon application, the ticket was dismissed. Phew!  
 
Now that that ticket is out of the way, I am hoping to fight my girlfriend's ticket for Reg Sticker Expired (j)(3).  
 
However I think I may opt to apply for the reduced amount online. However, if you can find the time in your schedule to check this notice of violation # 797789243-1 It would be greatly appreciated.  
 
The complainant's comments are as follows: 
No permit/no driver/no prior 
summons visible 
Sticker # FD607475  
 
The Place of Occurrence is stated as follows:  
N/S E 68th St ( It can't be North AND South ???) 
10 ft E of 5th Ave 
 
What really grinds our gears is the fact that she acted as a reasonably prudent person would and should. She applied by mail for the renewal of her registration sticker with more than a month for processing and transit. More than ample time to process a simple transaction. Apparently not ample for the DMV and USPS.  
 
The expiration date on the Registration Sticker states 4/6/2012 
she was ticketed 4/8/2012 
The DMV processed the check prior to the ticketing date and she received her sticker in the mail on the 4/12/12 
 
Any available challenges out there for contesting this ticket based on the above? Or do you simply recommend taking the reduced fine? Sorry for the long post, just trying to fight the good fight!
