3 Tips to Fight NYC Parking Tickets and Win

 

Follow these steps and you will save money on NYC parking tickets                                                                                            fight nyc parking ticket

I love Twitter. I plug in the search term on my tweet deck, "parkingticket", and you cannot imagine the volume of tweets that follow ranting about parking tickets. Most of these tweets are rated R for violent language.  I wonder what these people do next? 

Here are your 3 steps to NYC parking ticket success:

  • Inspect the front of the parking ticket for mistakes, such as the wrong:
    • date, time, place of violation, violation code, license plate, registration expiration date, make/model
    • Absence of parking ticket agent signature
    • If any of the above information is incorrect, YOU WIN!
  • Investigate whether you have a defense for the parking violation you were charged with, for example:
    • Code 19 Bus Stop-your defense is that you stopped temporarily to discharge or receive a passenger(s); and did not block the path of a bus
    • Code 40 Fire Hydrant-your defense is that you were not parked within 15 feet of the fire hydrant; or, someone was sitting behind the steering wheel, ready to move your vehicle upon a request to do so
    • Code 46 Double Parking-your defense for non-commercial vehicles is that you were stopped dropping off or picking up a passenger(s)
    • Codes 16, 21, 34, or 46-If you are a commercial organization, you can beat these 5 code violations every single time, with the proper work order; or other document evidencing that you were engaged in a commercial activity at that location
  • If the front of your NYC parking ticket has no mistakes, and you can't muster up a valid defense; take advantage of the NYC parking fine reduction program. At least your fine will be reduced by approximately 18% to 22%

I urge you to follow these 3 steps to success. If you genuinely owe the ticket, pay it. Otherwise, stand up for your freedom to move about New York City without paying an extra tariff for lawfully parking your vehicle

I got a ticket in NYC at no standing taxi stand, I went outside of my car to buy food and all of sudden this car came up and started writing me up a ticket... I looked at the ticket and she spelled my license plate wrong she wrote a S instead of a G, everything else is correct , what should I do ? pay or ignore it ? or send in the ticket and say NOT GUILTY and say the ticket was written wrong with a different plate ? TIA

In order for a parking ticket warrior to establish a prima facie case against you, the material facts on the front of the parking ticket must be accurate. Since your license plate number is wrong, you are entitled to a dismissal. Here's what you do: 
 
1. Sign the back of the ticket 
2. Prepare a letter stating you plead NOT GUILTY because there is an error on the front of your parking ticket, i.e., incorrect license plate number 
3. Point out the specific error 
4. Make a copy of your vehicle registration 
5. Send your letter, parking ticket, and a copy of your vehicle registration to the address on the back of the parking ticket by CERTIFIED MAIL, RRR 
6. This way you will have a record of receipt by the DOF

Thanks for visiting our website and posting an excellent question. The precinct number on a NYC parking ticket is not a required element. Therefore, inserting the wrong precinct will not entitle you to a dismissal. 
 
I hope you have other grounds to beat your ticket. If not, apply for a reduction.

I received a bus zone ticket this weekend but on the front of the ticket it has the wrong color of my car. Is the wrong color of the vehicle enough for me to win?

I am sad to say, no. The color of your vehicle is not considered a required element entitling you to a dismissal of your parking ticket if omitted, misdescribed or illegible.

Got a parking ticket for parking beside an inoperable fire hydrant. Is there a defense to this ticket? It is so obvious that the hydrant was not working. I was so angry that a ticket was issued for this. I know that the ticket should not have been issued because the hydrant was not working.

You are not permitted to park within 15 feet of a fire hydrant, whether it is broken; or in working order. 
 
The exception to the rule is that you may park within 15 feet of a fire hydrant, as long as there is a driver sitting behind the wheel who is able to move your vehicle upon request to do so. This exception is valid between sun up and sun down.

I'm very proud of you for going through all the right steps to decide whether or not to fight your parking ticket. I think you covered all bases. 
 
Couple of suggestions...The grace period was vetoed by our Mayor. The City Council will override the Mayor's veto, for sure. But, hasn't happened yet. The rule will take effect 90 days after the veto override. 
 
Last thing you can check is to make sure the warrior inserted the meter number. If not, you can fight the parking ticket on that basis.

Great blog! I got an exprired meter ticket. The meter was jammed and couldn't insert a coin. So I chanced to park there, but to my luck after 10-15 mins max there's a ticket on my windshield. My question is what if the meter was jammed to begin with. Am I still respopnsible. Thanks!

Thank you for your kind words, they mean a lot to me. Important question! The Rules permit you to park at a broken meter for the length of time displayed on the parking sign regulating your space. So, if the hour limits are 2 hours, you are permitted to park for two hours. 
 
The big but is that you must be able to prove the meter is broken. 
 
 
 
You may find one of our blog posts on broken meter parking helpful. It will explain exactly how to proceed. In a perfect world, you are expected to report the broken meter. All is not lost, however, if someone else did.

I wish to warn you there is conflicting opinions about your right to double park while you pick up or discharge passengers. Some of the parking ticket cognoscenti believe it is never legal to double park a passenger vehicle. 
 
I believe it is legal to double park a passenger vehicle where parking or standing is permitted, to pick up or discharge a passenger. My authority is a guide published by the DOF, Adjudication Unit. 
 
What's your plan?

I received a "no standing in bus stop ticket" in the bronx, where I live. I thought that if you park far enough away from the bus stop that you would not get a ticket. I just learned the hard way. I parked in a bus stop (where I though that I was safe) but received a ticket. I have parked and many other people park here everyday and this is the first time in thirty years that I have seen anyone get a ticket.  
 
Thanks to you and your site that I just learned what I should have learned before the fact. Does the DMV does not put this information in their drivers ed books? I don't remember.

I received a "no standing in a bus stop" ticket. I thought that if you parked far enough away from a bus stop that you would be safe. I was so wrong. I just learned from your site the rule that I did not know before hand. People park in that same spot everyday. This the first time I have seen anyone get a ticket in that spot in thirty years.

Hi, I received a ticket at 9:30pm while parked 17 feet from the fire hydrant. I noticed after reading the ticket that the officer wrote down the wrong letter of my license plate instead of a M he put down N. Does this ticket entitle for a dismissal.

I have a question and an answer. 
 
First, Gene, you are entitled to a dismissal of your ticket (read the 4th comment regarding Ken in this post). 
 
I received a ticket for "Double Parking (f) (1) on March 30th, 2010, during the Passover Holiday. 
 
All of the information regarding my vehicle, time, and place of occurrence is correct. 
 
My reasoning for double parking that day was alternate side street cleaning--since the block is classified as residential, and has street cleaning on consecutive days (Monday, Tuesday). Always, there have never been tickets for alternate side double parking during the hours of street cleaning (8:30am-10:00am), and I assumed that I would be safe as other cars were double parked as usual that Tuesday. 
 
I found out later that since it was Passover, they suspended street cleaning, meaning I would be wrong. I know I cannot exactly claim ignorance, but Passover isn't exactly a major holiday in my book--could I get away with this ticket? And how would I fight it? 
 
An email reply would be great, if not, I'll check this thread again. Thanks!

I have a question about double parking. I got a ticket for double parking in front of our building. It's a dead end street and wasn't blocking anything. The dead end street is a two-way street. I was parked on the right side aligned with the right lane, i.e. cars parked on the right side of the curb. And to my left was another car which was aligned with the left lane cars parked at the curb. I parked there to pick up someone and it was pouring that day. It's a dead end street and I followed the direction of the cars of the right lane. I wasn't blocking anything. Can you assist with a defense? Thank you...

I'd love to help; but I'd need to see photographs. Generally speaking, you are not permitted to double park while operating a private passenger vehicle; unless you are actively engaged in dropping off or picking up a passenger. 
 
And even then, many judges and experts believe a private passenger vehicle can NEVER double park. Tough one to beat.  
 
Again, I'm happy to take a look at photographs.

I would definitely fight the parking ticket based upon a misdescribed required element, i.e., you license plate number. Please submit a copy of your registration and a photograph of your plate attached to your vehicle. 
 
In addition, if you can present the proper proof properly, I suggest offer a defense against the 15 foot fire hydrant rule. 
 
The more the merrier.

What about using prima facia for a defense by asking if the prosecution is finished? If the judge says, then you can say that ownership has not been established.If the judge says he has a copy of the printout from the DMV,you can say the documentary evidence was not presented in accordance with the rules governing the admission of documentary evidence. It was never mentioned by the prosecution.Citing California Supreme Court in people v.Rigney(1961)

Every State has different procedures for fighting parking tickets. New York City rules do not require warriors to attend parking ticket hearings. The required elements on the front of a parking ticket establish a prima facie case.  
 
If any of the required elements are omitted, misdescribed or illegible, a judge will dismiss it upon your application.  
 
If there are no defects, then you must defend the parking ticket on the merits. For example, if you are cited for No Standing, a defense is you were stopped temporarily to drop off or pick up a passenger. If you present the proper proof, properly of this defense, you win. 
 
Unfortunately, NYC doesn't pay much attention to NY cases. Fugetabout CA cases.

I received a parking ticket for the street cleaning but the exp. date of the vehicle is stated wrongly. The vehicle is registered till 31st of June and the ticket stated that the vehicle is registered till May. 
Do I have a chance fighting a ticket.

You may wish to send a letter by certified mail, return receipt requested to the address on the back of your parking ticket.  
 
Please state in your letter the expiration date is misdescribed. The correct date is 6-31, not 5-31; and be sure to enclose a copy of your vehicle registration.

My car was towed on june 23, 2010, because have of my car was parked next to an alternate side parking sign and half my car expired and he other half did not. When I picked up the car there was 1 parking ticket on the window which i paid. I just happened to go to the nyc ticket site and now i see an additional 3 tickets for the same violation and the same date. I HATE NYC and moving to TX soon (sorry i know it has nothing to do with the story). Anyway the main question is is there a time limit between tickets given on a vehicle for the same violation in a 24 hr span? And also this is the second time i get 1 ticket on my car and then find out I have more online WTF NYC?

You pose some great questions.  
It is customary for a parking ticket judge to dismiss a second parking ticket for the same violation, in the same space, if it is issued within one (1) hour of the first parking ticket. 
 
However, if a ticket is issued for a "status" violation, i.e., exp. registration, inspection sticker, missing plate, etc. a parking ticket judge will generally dismiss a second, third or fourth, etc. "status" parking ticket if issued within 24 hours of the others. 
 
You must be served with a NYC parking ticket. The law provides if you are present in the vehicle, a warrior must hand you the ticket. If there is no operator in the car, the warrior must place the parking ticket on the windshield.  
 
Unfortunately, the PVB ignores this law. So, for a practical matter, you'll be stonewalled by the PVB if you assert this defense. 
 
We hate to lose ya. Texas is a lucky State. We wish you the best.

If your vehicle is registered out-of-state, NYC parking ticket judges apply a lesser standard for the make of your vehicle, i.e., "reasonably accurate." 
 
What state? What make was inserted? What is the correct make of your vehicle? 
 
You other option is to apply for a reduced fine. It will be lowered from $115 to $90.

Unfortunately, my car still has MA plates. It's a Mazda, and it got confused with a Toyota, according to the ticket. I guess I could at least ask for the fee to be reduced. What is the procedure for that? (should I still contest the ticket?)

I was thinking, did the warrior insert the month and year of your expiration date on the parking ticket? Mass has the info on the plate/windshield. Sometimes the warriors get lazy and insert NS or NA. 
 
If month/date is inserted correctly on your ticket, look to your right and you'll find a list of blog posts in alphabetical order. Click on Apply for reduced fine (shortcut) and it will guide you through the simply steps to secure an online reduction of your fine.

Many thanks for the message. I double-checked, and - indeed - he put a N/S on the ticket, despite the fact that the plates clearly state the expiration date. So I guess this (together with the wrong make) should be reason enough for dismissal... I'll try digging for information on what forms/proof to send (I am sure it's hidden somewhere here on the website :-) ).

Great news! 
 
Submit a copy of your vehicle registration along with a few photographs showing your car with plates attached; and a close up of your plate (showing month/year clearly displayed). 
 
Raise both misdescribed make and requirement month/year be inserted on your ticket if displayed on your plate as your defenses. (fight by mail. Send defense package certified mail, return receipt requested).

I got a ticket for an expired meter and the license plate number is wrong (and no vin or registration number). I saw where you previously wrote that this can be dismissed and to send in a "not guilty" plea along with a copy of my registration showing my correct license plate number. I'm concerned though that if I do this, they will then have my CORRECT information and I can be held liable. After all, I did in fact get the ticket. I had just walked out of the hospital where I'd been visiting a close family member when I saw the attendant writing the ticket. I'm usually so conscientious but guess I lost track of time. I must have distracted him because he got the license number wrong. So, in reality, the ticket is mine. I'm concerned that if I give them my accurate license number I'll have to pay. Any thoughts would be appreciated. (Btw- this site is great! Very helpful.)

Thanks for joining the conversation with a question I get asked quite often. You have two options:  
 
1. FIGHT--You will win. Your parking ticket will be dismissed because the plate # is a required element and must be entered correctly for a warrior to make a prima facie case against you.  
 
2. IGNORE--Your parking ticket will not be listed under your correct license plate number on the DOF website because your vehicle is identified by LICENSE PLATE NUMBER and the warrior mis-wrote.  
 
Sadie, Are you sleeping like a baby...Or, is the last thing on your mind before you fall asleep, your NYC parking ticket? Therein lies the answer about which path to follow.

I got a ticket last night under code 21, street cleaning started at 12 and i showed up at 12:45 to find the officer writing my ticket. Because I cooperated with her and was nice she marked down my car as a black Mercedes when I have a Black Saab. Also where the ticket says Name or Vin there is nothing. Is the mistake of the mercedes/saab enough to not have to pay the ticket as the officer told me? If so what are the necessary steps to not paying the fine? Please let me know asap. Thank you!

Wow. The warrior really did you a favor. "Make" is a required element and must be entered accurately on your parking ticket by the warrior, or you win upon application. Nice guys finish first. Congratulations. 
 
I suggest you prepare a Defense Letter and state the Make is incorrect. You vehicle is a Saab, not a Mercedes (color doesn't matter). Enclose a copy of your vehicle registration and respectfully request His Honor to dismiss your parking ticket. 
 
Make sure you send in your Defense Letter and Registration to the address on the back of your parking ticket by Certified Mail, return receipt requested. You'll need proof of receipt.

I've got a parking ticket where the plate number looks wrong. What is supposed to be a "G" looks exactly like a 6. Without prior knowledge no one would know it's a G. 
 
I even entered it as a 6 myself when I was looking up my plate number on the NYC parking ticket website. That's how I discovered the error. 
 
Problem is the ticket is listed under my correct plate number on the website. 
 
Can I still contest this ticket on the grounds that they got the plate number wrong?

Thanks for stopping by and joining the conversation. You raise a good point. Here's my take. If you enter your CORRECT plate number and it comes up on the DOF website, than the plate number is correct. 
 
You are raising the defense of "illegible required element" (plate #). Tough defense win. 
 
Your options are to fight, based upon the foregoing defense; or apply for a reduced fine. Your call.

Thanks for your helpful advice! And, for your closing question. I was in fact stressing about the ticket (even though it couldn't be traced back to me). I couldn't decide if I should fight it, or ignore it. Then I re-read your question: "Are you sleeping like a baby...Or, is the last thing on your mind before you fall asleep, your NYC parking ticket? Therein lies the answer about which path to follow". You made me realize that I was obsessing needlessly. I wound up ignoring it and not stressing about it. Last night, just before tossing it, I decided to file a "not-guilty" plea but did not include any of my contact information. I didn't want the person who actually had that number to go through the hassle of fighting it so I figured I'd explain the error just in case it helped. I explained that the ticket did not belong to the license number listed on it and that if they looked up that license they would find that it does not match the make and model of the car on the ticket. Anyhow, your advice was helpful because without it, I would have filed and fought it and had to include registration, etc. and follow up till it was dismissed, etc... Now I can just toss it. Thank you.

I was given a parking ticket back in july of this year and some of the information on the front of the ticket was incorrect..the model was listed as 4 door when i own a coupe and the color was written down as white when my car is silver. I sent my plea of not guilty and a copy of my registration to show the error. when i went to look up my plate info recently i was surprised to see that the hearing was complete and i was still found guilty. do i have any recourse? thank you

Good evening. Thanks for taking your valuable time to visit our website and post a great question. If your vehicle was registered in New York, you have a very reasonable chance to win on appeal. 
 
If your vehicle is registered out-of-New York, the judges generally apply the standard of "reasonably accurate" description; which allows the rogue parking ticket warrior a lot of latitude in inserting a wide variety of so called "reasonably accurate" descriptions of the body type of your vehicle.  
 
In either case, what do you have to lose, except your valuable time, in appealing this decision? Maybe the next batch of judges will see it your way.

Can you get 2 tickets for the same viloation 45 minutes apart for alternate side parking violation? I received 2 of them from 2 different police departments. I also received a ticket when the big storm hit for angle parking at 2 am when several other cars were parked the same but recieved no violations but the ticket did not have my vin#.

Good afternoon. It is the generally accepted practice by parking ticket judges to dismiss the second parking ticket received, for the same violation in the same space within 1 hour of the first violation.  
 
You are a winner. I suggest to fight the ticket on that basis. Send your Defense Letter by certified mail, return receipt requested to the address on the back of your parking ticket. 
 
Please refer to the second summons number in the body of your Defense Letter; and include the first summons number in your subject line.

I parked on w36th street in Manhattan in the commercial parking zones in error, I bought a ticket and missed the red sign indicating the rules.  
 
My ticket has an error. My car's color is indicated as RED when it is ORANGE, as shown on the manufacturers specs. I know this may be cheeky, but do I have a valid claim to dispute my ticket?
